Lottery cannot deny prize to teenager who won draw, says TJ-RJ
Although lotteries cannot sell game tickets to minors, they are obliged to pay the prize if it is drawn. With this understanding, the 12th Civil Chamber of the Rio de Janeiro Court of Justice ordered the Rio de Janeiro State Lottery (Loterj) to pay R$25,000 to a 16-year-old teenager, for a draw in 2013.
The ticket was purchased by a B2B Lead man who preferred to enter the name and details of his daughter, who was 11 years old at the time. He thought the strategy would bring luck. Possibly he did.
The problem is that the Rio de Janeiro State lottery refused to make the payment, claiming that, according to the rules of the draw and the legislation of the Child and Adolescent Statute, the sale of tickets to minors is prohibited.
The case's rapporteur, judge Jaime Dias Pinheiro Filho, stated that payment is mandatory, as otherwise the entity would be unjustly enriched.
“Although it says, in small print, 'prohibited for under 18s', the lottery ticket does not require the player to prove their age at the time of sale. In this way, the lottery cannot sell a ticket with a minor as the beneficiary and subsequently refuse to pay the prize,” he declared.

The other judges of the 12th Civil Chamber followed the rapporteur's vote and denied Loterj's appeal not to make the payment. Interest and monetary correction will be added to the prize of R$ 25 thousand from the date of the draw, on June 16, 2013. With information from the TJ-RJ Press Office.
